In the decision below, the court found the "for cause " termination clause in the employment contract unenforceable, as being contrary to the Ontario Employment Standards Act and further found, based on caselaw, that all termination provisions were unenforceable. The respondent was entitled to damages based on the end date of the fixed-term employment contract.
