In the following case, the Landlord was seeking $35,000 compensation for damages allegedly caused by Former Tenants. The Landlord and Tenant Board dismissed the application finding that there was insufficient evidence of undue ( significant/considerable) damage caused by the tenants. There was evidence of minor marks on walls, doors and trim but that was classified as falling within normal wear and tear. The Former Tenants produced considerable photographic and video evidence showing the condition of the rental unit on the day they vacated, to help rebut the Landlord's case.
