Rabbani v. Furney 2024 ONCA 943 :Debtor/Creditor Litigation

In the Rabbani case , monies were owing on 3 promissory notes and a mortgage as well as interest. The lower court found that this lawsuit was "simply a collection matter which has been delayed for an inordinate amount of time with no genuine issue for trial" and granted summary judgment in favour of the Plaintiff Creditor for $131,854 plus costs. The appeal of this decision was dismissed by the Ontario Court of Appeal with costs payable by the Debtors.
