Limitation Period and Abuse of Process

In the case below , the court found the action to be statute barred, having being advanced outside a Limitation Period. The Court further found the action to be an abuse of process as the Plaintiff was not allowed to recover proceeds from illegal conduct. The Action had no meaningful chance of success. The Court struck the claim and dismissed the action. This was not a case for trial.
