Commercial Tenancy: Scope of Premises

A dispute arose between a commercial landlord and tenant over the scope of the premises covered by their lease agreement. The court found that prior to signing the lease, it was the tenant's responsibility to ensure that the premises that it was choosing to lease had sufficient facilities for its purposes, and that if it required space ( in this case in the basement premises) to place equipment or other items, the tenant ought to have ensured this provision was specifically identified in the lease.
