Breach of Agreement of Purchase and Sale

The Superior Court of Justice granted summary judgment in favour of the Vendor, finding the buyers breached the Agreement of Purchase and Sale and awarded damages of $142,757. 89. This totaled the loss on the sale price ($232,400) plus property taxes ($1,164.97) and utilities ($2,932.92), less the deposits paid ($93,740). The court found the damages awarded placed the Vendor in the position it would have been in ,had the contract been performed as agreed. The Court of Appeal dismissed the buyers' appeal.
