Agreement of Purchase and sale: Failure to close

The court found that the Defendant Vendor repudiated the Agreement of Purchase and Sale and this repudiation was accepted by the Plaintiff and both parties thereafter understood the Agreement was terminated. The court ordered the $50,000 deposit to be returned to the Plaintiff.
